Timothy James Kelly was born in 1969 in Glen Cove, New York. He earned his undergraduate degree from Duke University and received his Juris Doctor from Georgetown University Law Center. He clerked at the U.S. District Court for the Eastern District of Pennsylvania.

Kelly spent a decade as a federal prosecutor, serving first as an Assistant United States Attorney in the District of Columbia and then as a trial attorney in the Public Integrity Section of the Department of Justice’s Criminal Division. He went into private practice as a civil litigator.

Kelly was nominated by President Donald Trump in June 2017 to serve as a United States District Judge of the U.S. District Court for the District of Columbia. His nomination was confirmed by the Senate, and he received his commission in September 2017.

Kelly is married and has two children.

D.C. Circuit U.S. District Court Judge Timothy Kelly granted the U.S. Department of Justice’s request to dismiss the convictions of four Proud Boys leaders related to the January 6, 2021, riots at the U.S Capitol. While President Trump had previously commuted their prison sentences, U.S. Attorney Jeanine Pirro later filed to dismiss the underlying charges. Judge Kelly stated that, under Supreme Court precedent, courts are constrained to dismiss charges when prosecutors ask that they be dropped.

Judge Kelly wrote in the opinion, “President Trump’s views about the prosecution of those who attacked the U.S. Capitol on January 6 — whether those views are based on fact or fiction — are well known, as is his intention to extend clemency to them through the Executive Order.”

Judge Kelly added, “Moving forward, if this Nation’s experiment in self-government is to last another 250 years, the American people — no matter their partisan preferences — will have to act together to preserve, protect and defend that miracle through our constitutional framework.”
